These marketplace terms apply when you browse, submit, publish or respond to an equipment listing on Podiatry Supplies.
Podiatry Supplies is operated by Impact Fitness Ltd, trading as Podiatry Supplies, company number 05487691, registered at 32a High Street, Brackley, Northamptonshire NN13 7DS.
By using the marketplace, you agree to these terms.
1. Our role
Podiatry Supplies provides an online classified advertising service through which third-party sellers can advertise podiatry equipment and related items.
We are not the seller, buyer, owner, agent, auctioneer, payment provider or delivery company for advertised equipment.
Any agreement to purchase an item is made directly between the buyer and seller. Podiatry Supplies is not a party to that agreement and does not receive or hold payment for the item.
Unless expressly stated, we do not:
- Inspect, test or certify advertised equipment
- Verify ownership, condition, service history or value
- Confirm the identity or professional status of a user
- Provide a warranty or guarantee
- Arrange payment, delivery, collection or installation
- Endorse a seller, buyer, listing or item
2. Seller responsibilities
The seller is responsible for their listing and the item offered for sale.
Sellers must:
- Provide accurate and current information
- Use photographs showing the actual item
- State the make, model, age and condition where known
- Disclose known faults, damage, missing parts and modifications
- Provide an accurate price and location
- State if collection, delivery or postage is available
- Describe relevant service, maintenance and testing history honestly
- Have the legal right to sell the item
- Respond to enquiries honestly
- Remove or mark the listing as sold when it is no longer available
- Comply with all applicable safety, product, consumer and trading laws
A seller acting for business purposes must identify themselves as a business or trade seller. They must not present themselves as a private seller to avoid their legal responsibilities.
The words “sold as seen”, “untested” or similar wording do not remove any legal responsibility that applies to the seller.
3. Equipment safety
Anyone supplying second-hand equipment for use at work may have legal duties relating to its safety and the information provided with it.
Equipment advertised for clinical or workplace use must, so far as reasonably practicable, be safe and without risks to health when supplied. Sellers should provide operating and safety instructions where available.
Sellers must clearly disclose:
- Safety defects or damage
- Missing guards, covers or protective parts
- Electrical or mechanical faults
- Unauthorised modifications
- Missing instructions
- Outstanding recalls or safety notices
- Any reason why the item should not be placed into service
Equipment offered solely for parts, repair, refurbishment or recycling must be clearly described as such. The listing and any subsequent transaction record should state:
FOR PARTS OR REPAIR – NOT FOR CLINICAL USE
Podiatry Supplies may reject or remove an item that appears unsafe, misleading or unsuitable.
4. Prohibited listings
You must not advertise:
- Stolen or unlawfully obtained property
- Counterfeit equipment or products
- Recalled products that cannot lawfully or safely be supplied
- Equipment known to be unsafe unless clearly offered for legitimate parts, repair or recycling
- Prescription medicines, controlled drugs or medicinal products
- Used sharps, contaminated items, biological materials or clinical waste
- Products containing patient records or personal data
- Items with removed or altered serial numbers
- Illegal products or services
- Misleading, fraudulent or speculative listings
- Items that infringe copyright, trademarks or other rights
- Anything prohibited by UK law
This list is not exhaustive. We may reject or remove any listing that creates a legal, safety, reputational or fraud risk.
5. Listing approval and moderation
All listings may be reviewed before or after publication.
We may:
- Edit formatting, spelling or layout
- Request further information
- Correct an obvious category or display error
- Refuse, suspend or remove a listing
- Remove photographs or claims that cannot be supported
- Restrict or block access to the marketplace
We will not materially change the description of an item without contacting the seller.
Approval does not mean that we have inspected, verified or endorsed the item.
6. Listing charges
The applicable price, duration and features will be displayed before the seller places an order.
The listing charge pays for the advertising service described at checkout. It is not a deposit or payment towards the advertised equipment.
Optional promotion does not guarantee views, enquiries or a sale.
7. Advert review, approval and payment
All adverts are reviewed before publication. Payment of a listing fee does not guarantee that an advert will be published.
We normally review submitted adverts within one working day. We may contact the seller to request reasonable corrections, additional information or replacement images before approving an advert.
We may reject an advert if it contains prohibited or unsafe items, misleading or incomplete information, unsuitable images, suspected fraudulent activity, or content that breaches these Marketplace Terms.
If we cannot approve an advert, we will contact the seller and provide a full refund of the listing fee. No listing period will be deducted.
The paid listing period starts when the advert is published, not when payment is made.
The listing fee pays for advertising space and related listing services. It does not guarantee enquiries, a sale or any particular result.
8. Cancellations and refunds
If we reject a paid listing before publication, we will refund the listing charge.
If you ask to cancel before publication, contact us promptly. Any refund will depend on the work already completed and your statutory rights.
If you purchase the listing service as a consumer, you may normally have a 14-day cancellation period. If you ask us to begin the service during that period, we may make a reasonable deduction for the service already supplied. Your cancellation right may end once the service has been fully performed following your express request and acknowledgement.
We do not normally refund a listing charge after publication merely because:
- The item does not sell
- The seller changes their mind
- The seller receives few or no enquiries
- The seller has supplied incomplete or inaccurate information
- We remove the listing following a breach of these terms
Nothing in these terms affects your statutory rights.
9. Buyers
Buyers must make their own checks before agreeing to purchase an item.
You should:
- Confirm the identity and contact details of the seller
- Establish if the seller is acting privately or as a business
- Inspect valuable equipment before paying
- Check ownership, serial numbers and recall information
- Request service records, instructions and proof of testing
- Arrange an independent inspection where appropriate
- Agree the price, payment, collection and delivery terms in writing
- Follow the guidance on our Buying and Selling Safely page
Do not rely solely on the listing or treat its publication as approval from Podiatry Supplies.
10. Payments and delivery
Podiatry Supplies does not collect, process or protect payments between buyers and sellers.
Buyers and sellers are responsible for agreeing:
- The purchase price
- The payment method
- Collection or delivery
- Insurance and transport
- Inspection and acceptance
- Installation, commissioning and testing
- Returns, refunds and warranties
Be cautious if someone requests advance payment, changes payment details unexpectedly or creates pressure to complete quickly.
11. Disputes and suspected fraud
Disputes about an item or transaction must be resolved between the buyer and seller.
We may review a reported listing and may suspend or remove it, but we are not obliged to mediate or determine liability.
Report suspicious listings through our Contact page.
If you believe a crime has taken place, contact your bank, the police or Action Fraud as appropriate.
12. Photographs and other content
By submitting content, you confirm that:
- You own it or have permission to use it
- It is accurate and lawful
- It does not infringe another person’s rights
- It does not reveal patient information or other unauthorised personal data
You give Podiatry Supplies permission to display, format and promote that content in connection with your listing and the marketplace.
You retain ownership of your content.
13. Availability of the service
We may change, suspend or withdraw any part of the marketplace.
We do not guarantee uninterrupted access, permanent storage of listings or compatibility with every device or browser.
14. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
To the fullest extent permitted by law, Podiatry Supplies is not responsible for:
- The accuracy of a third-party listing
- The condition, safety, legality or ownership of an item
- A buyer or seller failing to complete a transaction
- Loss caused by fraud or unauthorised payment
- Transport, installation or use of purchased equipment
- Indirect or consequential loss arising from a marketplace transaction
Your statutory rights remain unaffected.
15. Privacy
We process personal information in accordance with our Privacy Policy.
Information placed within a public listing may be seen, copied or indexed by other people and search engines. Do not include private addresses, patient information or other unnecessary personal data in a description or photograph.
16. Changes to these terms
We may update these terms when the marketplace, law or operating arrangements change.
The date at the top of this page shows when they were last updated. Changes will apply to new activity after publication.
17. Governing law
These terms are governed by the laws of England and Wales.
If you are a consumer, you may also benefit from mandatory legal protections available where you live.
18. Contact
Questions, cancellation requests and marketplace reports should be submitted through our Contact page.
